German Freight Forwarders’ Standard Terms and Conditions 2017

The German Freight Forwarders’ Standard Terms and Conditions 2017 (ADSp 2017) are a joint recommendation of the associations of the shipping industry and the freight forwarding industry.

The ADSp 2017 continue the tradition, which has existed since 1927, of providing the companies involved from both industry and commerce as well as from the forwarding and transport sectors with a “ready-made set of contract rules” for the handling of all types of forwarding transactions. Even more than earlier versions, the new “ADSp 2017” ensure a balance of interests between the contracting parties through clauses that are balanced in terms of content.

What’s more: the ADSp 2017 are recommended for non-binding application not only by the Federation of German Industries (BDI), the Federation of German Wholesale, Foreign Trade and Services (BGA), the Association of German Chambers of Industry and Commerce (DIHK), the German Freight Forwarding and Logistics Association (DSLV) and the German Retail Federation (HDE), but also for the first time by the Federal Association of Road Haulage, Logistics and Disposal (BGL), the Federal Association of Furniture Forwarding and Logistics (AMÖ) and the Federal Association of Economics, Transport and Logistics (BWVL).

Forwarding transactions are regularly conducted on the basis of this tried-and-tested set of terms and conditions. The market acceptance of the ADSp is very high. Over 90 percent of German freight forwarders work on the basis of this set of clauses, which contains contractual terms tailored to freight forwarding activities. Companies in the shipping industry thus have the advantage of encountering uniform terms and conditions, even if they work with different forwarding partners.
